Terms of Service

1. Who we are and how these terms work

ClutchTip and AImanac are brands operated by the same Australian proprietary company (the Operator, "we", "us"). Our registered office is in Tweed Heads, New South Wales. Contact: [email protected].

These terms apply to your use of ClutchTip at clutchtip.com and any related app. If you do not agree to them, do not use the service.

We may change these terms. If a change is material we will give at least 30 days' notice by posting it on the site or, if you subscribe, by email. Continuing to use ClutchTip after that notice period means you accept the change.

2. What the service is

ClutchTip publishes pre-game sports predictions and analysis produced by our prediction engine, together with a public results ledger and historical prediction data.

• Pre-game predictions for a range of competitions, published as a card for each round or slate
• A results ledger that grades every published prediction against the final result
• Historical prediction data and performance dashboards
• AImanac, a companion app where you can ask about any game and get the engine's pre-game call

Predictions are pressed: recorded with a timestamp before a game starts, and locked once it has. If a prediction is revised before kickoff, the earlier version is kept and the revision is noted. Once a game has started the prediction shown is the one that was pressed; it is never rewritten to fit the result.

Some content is available without a subscription. Predictions and historical data are available to registered subscribers.

3. What the service is not

• Not gambling. We do not accept, place or facilitate bets, do not operate as or for a bookmaker, betting exchange or wagering operator, and have no affiliate, referral or commercial arrangement with one. We do not benefit in any way if you place a bet.
• Not odds or staking. We do not display odds, prices, expected value, bank management or staking suggestions.
• Not advice. Nothing we publish is financial, investment or betting advice, or a recommendation to wager. It is general information about a sporting contest. Any decision you make about a game, including any decision to wager, is yours alone.

4. Who may use it

You must be at least 18 years old and using ClutchTip for your own personal, non-commercial purposes. You may hold one account. You are responsible for what happens under your account and for keeping any login details confidential. If you use ClutchTip from outside Australia you are responsible for complying with local law.

5. AI-generated content

Predictions and reasoning are generated by software, including AI models, from publicly available information such as fixtures, ladders, team lists and news. That information can be incomplete, late or wrong, and the software can make mistakes. Each prediction is based only on information available before kickoff and does not account for anything that happens once a game is under way.

We work to keep the service accurate but do not promise that any prediction, figure or explanation is correct, or that the service will be available or error-free at any particular time.

6. The results ledger

The results ledger at clutchtip.com records every pressed prediction and grades it against the final result. Where a figure is described as full-slate, every game on the relevant card was tipped and counted. Where we publish backtested figures (performance on past data) they are labelled separately from live results.

Ledger figures are a historical record. They are not a promise about future performance or profitability, and a prediction being on the ledger does not make it advice.

7. Subscriptions and payment

Paid access is by subscription. Payments are processed by Stripe; we do not hold your card details. By subscribing you agree to pay the fee shown when you subscribe and that your subscription renews automatically at the end of each billing period until you cancel.

You may cancel at any time from your account or by emailing us. Cancellation takes effect at the end of the current billing period and you keep access until then.

We may change subscription prices. We will give you at least 30 days' notice by email before a change applies to you. If we offer an introductory or founding rate, any conditions attached to it are stated when you subscribe.

Apart from your rights under the Australian Consumer Law (see clause 11), fees are not refundable for part of a billing period, and we do not refund for change of mind.

8. Using our content

We own or licence the predictions, reasoning, ledger, software, designs, names and other content of ClutchTip. We give you a personal, non-transferable licence to use them for your own purposes while you comply with these terms.

You may share an individual prediction or card with friends, in a group chat or on social media, provided you keep the ClutchTip name and timestamp on it and do not present it as your own or as anything other than what it is.

You may not scrape, crawl, bulk-download or systematically copy the service; sell, licence or commercially redistribute our content; use it to operate, populate or improve any other prediction, tipping, betting or wagering product or service; remove attribution or timestamps; or attempt to reverse-engineer the prediction engine.

9. Acceptable use

You must not use ClutchTip for anything unlawful, to harass anyone, to interfere with or overload the service, to gain unauthorised access to any system, or to share account access with others. We may limit, suspend or end your access if you breach these terms or if we reasonably consider it necessary to protect the service or other users. If we end a paid subscription for a reason other than your breach, we will refund the unused part of the period.

10. Privacy

We handle personal information in accordance with our Privacy Policy, which forms part of these terms.

11. Australian Consumer Law and our liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth) or any other law that cannot be excluded by agreement. Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

Where the law allows us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again.

To the extent permitted by law, we are not liable for any indirect or consequential loss, loss of profit, or any loss arising from a wager or other decision you make in reliance on our content, and our total liability to you for all claims connected with the service is limited to the amount you paid us in the 12 months before the claim arose.

12. Third-party services

ClutchTip relies on third-party providers, including Stripe for payments and cloud infrastructure and AI model providers for generating and storing content. We are not responsible for those providers' services or for any third-party site we link to.

13. Governing law and disputes

These terms are governed by the laws of Queensland, Australia. If you have a complaint, email us first and we will try to resolve it with you within 30 days. Otherwise the courts of Queensland, and courts that hear appeals from them, have non-exclusive jurisdiction.
